General Terms and Conditions

This is a translation of the German original. In the event of any discrepancy, the German version shall prevail.

(hereinafter referred to as the “Organiser”). The trade fair is organised and run by boerding messe GmbH & Co. KG. Invoicing is handled by HRM Institute GmbH & Co KG.

These General Terms and Conditions of Use and Business (hereinafter referred to as the “Terms”) apply to the electronic ordering of all types of admission tickets issued by the Organiser (hereinafter referred to as “Tickets”) on the respective website of the event (hereinafter referred to as the “Website”). The Organiser reserves the right to amend these Terms at any time; such amendments take effect as soon as they have been published on this Website. The Organiser also reserves the right to discontinue or change the Website in whole or in part at its own discretion and without prior notice.

By placing an order, the person ordering or purchasing Tickets (hereinafter referred to as the “Customer”) accepts these Terms. Any deviating terms of the Customer shall not apply.

Tickets are issued exclusively via the print@home method. With print@home, the Customer conveniently prints the ticket themselves, which saves time and costs. All the Customer needs is a standard printer and normal A4 paper. After a successful order and/or purchase, the Organiser sends the Customer an email with the ticket as a PDF to the email address provided during registration.

1. Contracting parties

The Organiser also issues the Tickets. By ordering free Tickets or purchasing Tickets, contractual relationships are established exclusively between the respective Customer and the Organisers.

2. Conclusion of contract

The Customer submits an offer to conclude a contract by sending the offer entered in the order form, in particular the respective ticket type (day ticket, season ticket), a correctly entered email address and billing address as well as all data required for payment processing, by clicking the corresponding buttons. After a successful order (for free Tickets) or purchase and online payment, the Customer receives a confirmation from the Organiser by email together with PDF files for printing the Tickets at home via the print@home method.

3. Return of paid Tickets / right of withdrawal

Purchased, stolen, damaged or destroyed Tickets cannot be exchanged or refunded. Every order of Tickets is therefore binding immediately after confirmation by the Organiser and obliges the Customer to accept and pay for the Tickets ordered in accordance with Section 312b (3) of the German Civil Code (BGB) on distance contracts. Withdrawal from the contract is likewise excluded. If the person ordering is unable to attend, they may nominate a substitute participant. The only exception applies to Tickets for (a) cancelled or (b) postponed events. In these cases, the original Customer is entitled to a refund of the price actually paid. Tickets do not then need to be returned but are automatically declared invalid. If the Organiser receives information about cancelled or changed event dates, the Organiser will inform the Customers by email without delay, provided the Customer entered a valid email address when ordering. Any further claims are excluded.

If a Ticket is lost, the purchase price cannot be refunded. If the print@home ticket was not delivered because of an incorrect email address, please contact info@hrmri.org. We will get in touch with you immediately and arrange for the ticket to be resent to the correct address.

4. Conditions of the money-back guarantee:

The money-back guarantee is offered as an option and is subject to the following conditions:

Insured events:

The money-back guarantee covers a refund of the ticket price in the following cases:

Period of cover:

The money-back guarantee only applies to events that occur during the period of cover. This begins when the ticket is purchased and ends when the event begins.

Reporting claims:

In the event of an insured event, the ticket holder must report the claim by email to support@hrm.de within 3 days of the event. The report should include all relevant documents and evidence (e.g. medical certificates, death certificates, letters of dismissal). Events must be verifiably documented. If the insured event prevents the ticket holder from reporting in time (e.g. during a stay in hospital), the deadline may be extended.

Refund amount:

The refund is limited to the original ticket price. Additional fees or costs incurred when purchasing the ticket (e.g. service fees or shipping costs) will not be refunded.

Additional rule for free or discounted tickets:

If the ticket holder subsequently receives a free or discounted ticket from the Organiser, then on presentation of the corresponding voucher code either the full ticket price is refunded (for free tickets) or the difference between the original purchase price and the discounted ticket price is reimbursed.

Exclusions:

The money-back guarantee does not cover events caused by intentional or grossly negligent behaviour of the ticket holder. Events resulting from pre-existing medical conditions of the ticket holder are likewise excluded from cover.

Scope:

The money-back guarantee only applies to tickets purchased through the official sales channel. Tickets from unauthorised sources are excluded from cover.

Evidence:

To have a claim processed, the ticket holder must substantiate the insured events with suitable evidence (e.g. medical certificates, death certificates, letters of dismissal). Without complete and verifiable documentation, the claim may be rejected.

Changes to and cancellation of the event:

In the event of changes to or cancellation of the event that are not attributable to insured events, our general return and refund policy applies.

5. Prices and prohibition of commercial use

Prices for Tickets are always subject to change, include statutory VAT of 19 percent and are shown on the respective Website. Purchasing Tickets for the purpose of resale is generally prohibited.

6. Terms of payment

The total amount including VAT is due for payment immediately after conclusion of the contract. Online orders can only be paid via PayPal. If the Customer does not wish to use this payment option, online pre-registration for paid Tickets is not possible. On the day of the event, the Customer can still register on site and pay by credit card at the fair, but will then not benefit from the print@home function, lower prices and fast admission to the fair. Tickets remain the property of the Organiser until paid in full. If a payment is charged back, the Tickets are automatically declared invalid. The Customer does not need their own PayPal account to pay via PayPal. During the ordering process, the Customer is free to pay by credit card, direct debit or debit from their PayPal account. Further information on the PayPal payment system is available at www.paypal.com. All amounts are due for payment immediately upon conclusion of the contract without deduction. The invoice is issued by HRM Institute GmbH & Co KG, Rheinkaistraße 2, D-68159 Mannheim, DE 258273789. The respective invoice is sent to the Customer as a PDF file after the confirmation. By ordering Tickets, the Customer agrees to invoices being issued and sent electronically. There is no entitlement to a paper invoice. 7. Admission for trade visitors/trade participants only

Events organised by HRM Institute GmbH & Co KG are aimed exclusively at trade visitors and trade participants. The Organiser therefore reserves the right to check trade visitor status appropriately and to refuse admission to visitors from other professions. This also applies retrospectively if a Ticket has already been purchased online. In such cases, we charge a transaction fee of EUR 10.00 for refunding the Ticket.

8. print@home method (applies to all Tickets ordered/purchased)

Tickets are sent at the Customer’s risk by email as PDF file(s) together with the confirmation email at the time the contract is concluded. The Customer is obliged to check the PDF documents for accuracy and completeness immediately after receipt (in particular the name of the event, date, time, price and quantity, name of the participant) and to report any complaints to the Organiser. The Customer will then receive a free replacement in return for the PDF Tickets already sent, provided that any complaints are reported to the Organiser in writing by email within 7 working days (email: info@hrmri.org), as Tickets are personalised and non-transferable. Tickets ordered via the print@home method are delivered directly to the Customer by printing out the Tickets sent electronically. The Customer may only make one printed copy of each Ticket for its intended use; the Customer is otherwise not entitled to reproduce, duplicate or alter the printed Ticket in any form whatsoever. A print@home Ticket that has been duplicated or resold without authorisation does not entitle the holder to attend the event. The single-use barcode on the document is invalidated electronically by barcode scanner at the venue. It is therefore impossible for further persons to gain access to the event with the same barcode, e.g. by duplicating it. Should copies of a print@home Ticket appear, the Organiser reserves the right to refuse admission to the holders of the copies or to the holder of the print@home Ticket duplicated without authorisation. The Organiser further reserves the right to demand from the Customer whose Ticket was duplicated without authorisation payment of the total value of the duplicated print@home Tickets. The Organiser accepts no responsibility for any inconvenience caused by unauthorised duplication or misuse of print@home Tickets. print@home Tickets should be kept in a safe place, like cash or conventional tickets, to prevent misuse. The Organiser accepts no responsibility whatsoever in the event of loss and/or misuse of the Tickets.

9. At the venue/on site at the fair

a. Sound, photo and video recordings

For copyright reasons, trade visitors are not permitted to make image, sound or video recordings at the venue. If persons commissioned by the Organiser make image and/or sound recordings during the event, attending the event grants unrestricted rights of use and publication with regard to sound, photo and video recordings on all sales and distribution channels.

b. Name badge

Tickets are personalised and consist of an information section and a name badge. The name badge serves as the trade visitor’s identification on site, entitles the holder to admission to the event and must therefore always be worn clearly visible. It contains the following personal data from the online order via the Website: first name, last name, position and company name. A further element of the name badge is a barcode for access authorisation, which is checked and invalidated electronically by barcode scanner by the Organiser at the venue. The Ticket also contains a QR code with a vCard holding, in encrypted form, the visitor’s electronic business card with the personal data from the online registration. Specifically, this is company, street, postcode, town, country, salutation, title, first name, last name, position, email address and telephone number.

10. Liability and damages

The Organiser is liable without limitation for damage suffered by the Customer and/or the registered person only if it results from intentional or grossly negligent conduct on the Organiser’s part. In the case of slightly negligent breaches of duty, the Organiser is only liable for a breach of its essential contractual obligations (cardinal obligations). In this case, the Organiser’s liability is limited to the direct damage typical for the contract and foreseeable at the time the contract was concluded. This also applies to breaches of duty by the Organiser’s legal representatives and/or vicarious agents. Liability for culpable injury to life, body or health remains unaffected by this limitation of liability. The Organiser will endeavour, as far as technically possible, to keep the Website running free of errors and interruptions, but gives no guarantee of this. Furthermore, the Organiser gives no guarantee that the Website is free of viruses or other harmful components. Liability in this respect is likewise excluded.

11. Use of this Website

The Customer undertakes to use this Website exclusively to purchase Tickets. Without express permission, it is prohibited to set up deep links to this Website for any purpose whatsoever. The Customer undertakes not to use any robot or spider software and not to attempt in any other way, automated or manual, to monitor or copy this Website and its content. The Customer further undertakes not to interfere in any way with the proper functioning of this Website, in particular not by deliberately overloading the Organiser’s system infrastructure. The Organiser will pursue any illegal and/or unauthorised use of this Website, in particular unauthorised Tickets, unauthorised framing of or linking to the Website or the unauthorised use of any robot, spider or other software, and will take appropriate civil and criminal action.

12. Place of jurisdiction and applicable law

The mutual rights and obligations arising from this contractual relationship are governed by the law of the Federal Republic of Germany. The place of jurisdiction is the Organiser’s registered office, Mannheim.

13. Final provisions

Should individual provisions of these Terms be or become invalid, this shall not affect the validity of the remaining provisions. In such a case, the invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.

Information on the handling of customer data
(privacy policy)

The personal data entered by the Customer on this page are used to contact the Customer by email and, if the Customer has agreed to receive the newsletter during registration, to keep the Customer informed about the event in future. The Organiser points out to the Customer that their details are also stored and processed in the Organiser’s IT systems to the extent required, in accordance with data protection regulations, for further processing, for the purpose of executing the contract (invoicing, recording receipt of payment, automatic creation of the print@home ticket) and for running the event (checking and identifying the Customer and invalidating Tickets at the venue). Customer data are not passed on to third parties.

Messe Zürich is excellently connected to public transport. From Zurich main station, trains run every few minutes to Oerlikon station (including S2, S6, S7, S8, S9, S14, S15, S16, S19, S24); from there you can reach the fair on foot, by tram no. 11 or on bus lines 61, 62 and 94.

By car, follow the «Z» signs on the motorway to the exhibition grounds. Parking is available at the Parkhaus Messe Zürich on Hagenholzstrasse, including charging facilities for electric vehicles.
